Oman overtime rates (Articles 70 to 72)

OvertimeBy day9 pm to 5 amRest day or public holiday
Agreed (Article 71)+25% (125%)+50% (150%)+100% of a day's basic, or a day off
Without consent (Article 72)+50% (150%)+75% (175%)+200% of a day's basic, or 2 days off for a public holiday

Normal hours are at most 8 a day and 40 a week, with a 1 hour break a day that is not counted, and at most 6 hours in one stretch (Article 70). You get at least 2 paid rest days in a row each week (Article 77). Agreed overtime may not take the day above 12 hours in all (Article 71). Article 72 says 200% of the basic wage without the word daily. We read it as a day's basic, like Article 71. Some websites still say 9 hours a day and 45 a week, which was the old law.

How do you work out your overtime pay?

  1. Hourly wage = basic wage ÷ 30 ÷ 8 (or ÷ 173.33 if your employer uses it).
  2. Day overtime = hours × hourly wage × 1.25 (× 1.5 under Article 72).
  3. Night overtime = hours × hourly wage × 1.5 (× 1.75 under Article 72).
  4. Rest day or holiday = days × basic ÷ 30 × 1 extra (× 2 under Article 72), unless you take time off instead where the law allows it.

Overtime example (basic OMR 300, ÷ 30 ÷ 8 = OMR 1.25 an hour)

What about overtime in Ramadan?

In Ramadan the normal day for Muslim workers is 6 hours and the week 30 hours (Article 70). Our reading is that hours above 6 a day are overtime. Two extra day hours for 20 days on a basic of OMR 300 is 40 hours × OMR 1.56 = OMR 62.50. The law does not say whether the hourly wage in Ramadan is worked out on 6 or 8 hours; the calculator keeps the normal month's hourly wage.

Keep a record

Write down the date, start and end time of each extra hour, rest day or holiday you work, and whether you agreed to it. If your pay does not match, raise it with your employer first, then with the Ministry of Labour. Unpaid overtime is part of your Oman final settlement when you leave.

Questions

How is overtime calculated in Oman?

Basic hourly wage plus at least 25% by day and 50% at night, for overtime you agree to (Article 71). With a basic of OMR 300 the hourly wage is 300 ÷ 30 ÷ 8 = OMR 1.25, so a day hour of overtime pays OMR 1.56 and a night hour OMR 1.88.

Is overtime in Oman paid on basic or gross salary?

On the basic wage. Articles 71 and 72 both use the basic wage.

What are the working hours in Oman under the new law?

At most 8 hours a day and 40 hours a week, with a 1 hour break a day that is not counted (Article 70). In Ramadan Muslim workers work 6 hours a day and 30 a week.

What counts as night work in Oman?

The hours from 9 pm to 5 am (Article 1(16)).

Can my employer make me work overtime without my consent?

Only in the Article 72 cases: stocktaking, the budget, closing the accounts or preparing a sale on up to 15 days a year, or to prevent or repair an accident, save goods that would spoil, or meet unusual pressure of work. That overtime pays more: at least 50% by day and 75% at night.

What is the pay for working on a rest day in Oman?

At least 100% of a day's basic on top of the day's wage, or another day off, if you agreed (Article 71). Without consent under Article 72, at least 200%. Only for a public holiday may the employer give 2 days off instead. Public holidays pay the same as rest days.

How many overtime hours are allowed in Oman?

Agreed overtime may not take the working day above 12 hours in all (Article 71).

Divide by 30 and 8, or by 173.33?

The law does not say. It counts a month as 30 days (Article 1(24)) and a normal day as 8 hours, so basic ÷ 30 ÷ 8 is our default. Some employers use 173.33 hours a month, which gives a higher rate. The calculator lets you pick either.
