What goes into a final settlement in Oman

PartRuleWage usedLaw
Wages owedDays worked and not paid × day's wageGrossArt. 91
Leave balanceDays left × day's wageGrossArt. 81
GratuityBefore 31 July 2023 half a month a year for 3 years, then a month; from 31 July 2023 a month a year; part years pro rataLast basicArt. 61, Ministry circular
Notice payNotice days not given × day's wage, paid by the side that ended the contract earlyFinal grossArt. 38
DeductionsOnly government dues and debts proven to the employerNot applicableArt. 96

A day's wage is the monthly wage ÷ 30, because the law takes a month as 30 days (Article 1(24)). The gross wage is the basic wage plus all allowances (Article 1(18)).

Worked example: the employer ends an open contract without notice

Joined 1 January 2022, last day 31 December 2025. Basic OMR 400, gross OMR 550. December not paid yet, 10 days of leave left, no notice given (30 days owed):

  • December wages: OMR 550.00
  • Notice pay: 30 days × 550 ÷ 30 = OMR 550.00
  • Leave balance: 10 × 550 ÷ 30 = OMR 183.33
  • Gratuity: 1.58 years before 31 July 2023 at half a month (OMR 315.62) plus 2.42 years from it at a month (OMR 969.86) = OMR 1,285.48
  • Final settlement: OMR 2,568.81

Worked example: you resign and serve your notice

Joined 1 September 2023, last day 31 August 2026, all under the new law. Basic OMR 300, gross OMR 420. 15 days of August not paid, 20 days of leave left, a proven loan of OMR 150 to repay:

  • Wages owed: 15 × 420 ÷ 30 = OMR 210.00
  • Gratuity: 1,096 days ÷ 365 = 3.003 years × OMR 300 = OMR 900.82
  • Leave balance: 20 × 14 = OMR 280.00
  • Less the loan: OMR 150.00
  • Final settlement: OMR 1,240.82

If the same worker had left 10 days before the end of the notice, they would owe 10 × 14 = OMR 140 for the notice not served (Article 38), so the settlement would be OMR 1,100.82.

A notice from the employer given while you are on leave starts the day after your leave ends, and during the notice you get 10 paid hours a week to look for a new job (Article 39).

Deadlines and your rights

  • Payment: immediately when the work ends, or within 7 days if you left the job on your own (Article 91).
  • Going home: the employer returns a non-Omani worker home within 60 days of the end of the contract (Article 14).
  • Deductions: only government dues and debts proven to the employer (Article 96).
  • Unpaid? Complain to the Ministry of Labour. The claim is lost one year after the right fell due (Article 9), so do not wait.
  • Leaving without notice: allowed with all your rights if your wages are unpaid for more than 2 months in a row, or in the other cases of Article 41.

When there is no gratuity

A worker dismissed for one of the nine reasons in Article 40, for example more than 7 days in a row of absence without an acceptable excuse, gets no gratuity. Wages owed and the leave balance are still paid. Omanis insured with the Social Protection Fund get end-of-service benefits from the fund, not from the employer (Article 61). For expatriates the fund's savings scheme starts at the latest in July 2027 (Royal Decree 60/2025); until then the employer pays the gratuity.

Each part on its own: Oman gratuity and Oman leave salary.

Questions

What is included in a final settlement in Oman?

Wages not yet paid, your leave balance on the gross wage (Article 81), the end-of-service gratuity on the basic wage (Article 61), notice pay if the notice was not given (Article 38), and anything else your contract gives. Government dues and debts proven to the employer can be taken off (Article 96).

How long does the employer have to pay the final settlement in Oman?

Article 91 says immediately when the work ends. If the worker left the job on their own, within 7 days.

Can my employer deduct from my final settlement?

Only government dues and amounts proven to be owed to the employer, such as a loan (Article 96). A loan cannot carry interest (Article 95).

Do I get gratuity if I resign in Oman?

Yes. Article 61 does not cut gratuity for resigning. You lose it only if you are dismissed for one of the reasons in Article 40.

What if I resign without serving notice in Oman?

You owe the employer the gross wage for the notice days you did not serve (Article 38). The notice is 30 days for monthly-paid workers and 15 days for others, unless your contract says more.

Is notice pay in Oman on basic or gross salary?

On the final gross wage (Article 38).

Do I get a ticket home at the end of my contract?

The employer must return a non-Omani worker to their country within 60 days of the end of the contract (Article 14). It is a duty to send you home, not a cash amount, so it is not added to the settlement here.

What if my employer does not pay?

Complain to the Ministry of Labour. A dispute goes to the ministry for settlement first, and a claim under the labour law is lost one year after the right fell due (Article 9).

Can I leave without notice and keep my rights?

Yes, in the cases of Article 41, for example if your wages are unpaid for more than 2 months in a row, or you are assaulted at work. You keep all your rights, including gratuity.
