Open-ended contractBeforeNow
Monthly wage, the worker ends it60 days30 days
Monthly wage, the employer ends it60 days60 days
Other wages, either side30 days30 days

Many pages still say 60 days for both sides. Since the amendments of Royal Decree M/44 the worker gives 30 days (Article 75). During notice from the employer you get a full day or 8 hours a week off with pay to look for a new job (Article 78).

Worked example: the employer ends it without notice

Actual wage SAR 8,000. Joined 1 January 2019, last day 31 March 2025 (2,282 days, 6.252 years). The employer gives no notice (60 days owed), 12 days of March are unpaid and 20 leave days are left.

  • Award: 5 × 4,000 + 1.252 × 8,000 = SAR 30,016.44.
  • Notice pay: 60 × 8,000 ÷ 30 = SAR 16,000.00.
  • Wages owed: 12 × 8,000 ÷ 30 = SAR 3,200.00.
  • Leave: 20 × 8,000 ÷ 30 = SAR 5,333.33.
  • Final settlement: SAR 54,549.77, due within one week.

Worked example: you resign after 4 years

Actual wage SAR 6,000. Joined 1 January 2021, last day 31 December 2024 (1,461 days), notice served, 10 leave days left.

  • Full award: 3,000 × 1,461 ÷ 365 = SAR 12,008.22; resigning with 2 to 5 years keeps one third: SAR 4,002.74.
  • Leave: 10 × 200 = SAR 2,000.00.
  • Final settlement: SAR 6,002.74, plus any wages still owed, due within two weeks.

Had the same worker left without serving the 30 days, they would owe the employer SAR 6,000 for the notice (Article 76).

Worked example: Article 77 compensation

Actual wage SAR 7,000, open-ended contract, 1 January 2022 to 31 December 2024 (1,096 days, 3.003 years), ended by the employer without a valid reason. 15 days × 3.003 years = 45.04 days, which is SAR 10,509.59. That is under the 2 month minimum, so the compensation is SAR 14,000.00. With the award of SAR 10,509.59 the settlement is SAR 24,509.59. From 4 years of service, 15 days a year passes the 2 month floor.

Resigning since 2025 (Article 79 bis)

  • A resignation is a written request, and it counts as accepted if the employer does not answer within 30 days.
  • The employer may postpone it by up to 60 days, with written reasons given within those 30 days.
  • You may withdraw it within 7 days, unless it was already accepted.
  • Your contract and your rights continue until it takes effect.

Each part on its own: Saudi end of service, Saudi leave salary and Saudi overtime. Notice rules in plain words: Saudi notice period rules.

Questions

What is included in a final settlement in Saudi Arabia?

The end-of-service award (Article 84, cut on resignation under Article 85), wages not yet paid, unused leave and the part year (Article 111), notice pay if the notice was not given (Article 76), Article 77 compensation if an open-ended contract was ended without a valid reason, and anything else your contract gives. Work-related debts you owe can be taken off (Article 88).

How long does the employer have to pay the final settlement in Saudi Arabia?

Within one week of the end of the work relationship, or within two weeks if the worker ended the contract (Article 88).

What is the notice period in Saudi Arabia in 2025?

For an open-ended contract with a monthly wage: at least 30 days if the worker ends it and at least 60 days if the employer ends it, since 19 February 2025 (Article 75). For other wages, 30 days either way.

What if I resign without serving notice in Saudi Arabia?

You owe the employer your wage for the notice days you did not serve, unless you both agreed on a larger amount (Article 76).

How is Article 77 compensation calculated?

15 days' wage for each year of service on an open-ended contract, never less than 2 months' wage. With SAR 7,000 and 3 years that is SAR 10,500, so the 2 month minimum of SAR 14,000 applies. For a fixed-term contract it is the wage for the rest of the term.

Can my employer deduct from my final settlement?

Work-related debts you owe the employer (Article 88). From wages, the law allows only the deductions in Article 92, such as a loan at 10% of the wage, and never more than half the wage due (Article 93).

Is the final settlement paid on basic or actual salary?

On the actual wage, basic plus allowances, because that is what the Labor Law means by wage (Article 2). Commissions can be left out of the award by agreement (Article 86).

What if my employer does not pay?

File a complaint with the Ministry of Human Resources and Social Development through its labour dispute (amicable settlement) service.
